The agreement
These Terms are a binding agreement between you ("you", "Customer") and [YOUR LEGAL ENTITY NAME], the company that operates HookSpy ("HookSpy", "we", "us"). They govern your use of the HookSpy hosted service, the dashboard, the CLI, and our website (collectively, the "Service").
By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
If you're agreeing on behalf of a company or other organization, you confirm you have authority to bind that entity to these Terms, and "you" means both you personally and the entity.
Your account
To use most of the Service you need an account. You agree to:
- Give us accurate information when you sign up.
- Keep your password secure and not share it.
- Be responsible for everything that happens under your account.
- Tell us promptly at security@hookspy.io if you suspect unauthorized access.
You must be at least 16 years old to use the Service. If you're using it on behalf of a company, you must have authority to do so.
Acceptable use
You agree not to use HookSpy to:
- Capture data you don't have a lawful right to collect, including data of third parties without their consent or another lawful basis.
- Send malware, exploit attempts, phishing payloads, or content that violates the law to your inbox URLs.
- Probe, scan, or test the vulnerability of the Service or circumvent its security.
- Reverse-engineer the Service except where applicable law permits.
- Use the Service for the bulk capture of personal data, surveillance, or stalking.
- Generate artificial load or run stress tests without our written permission.
- Resell the Service or use it as a shared inbox between unrelated parties to bypass per-developer pricing.
- Build a competing product using data extracted from the Service.
We may suspend or terminate accounts that violate these rules. Where the violation is severe (illegal content, attacks, large amounts of personal data abuse), we may do so without notice.
Your data
You own everything you put into the Service — your account info, the inboxes you create, and the webhooks they capture ("Customer Data"). HookSpy stores and processes Customer Data only to deliver the Service to you.
Where Customer Data includes personal data of your end-users, you're the data controller and HookSpy is the data processor under GDPR. We commit to:
- Process Customer Data only on your documented instructions.
- Apply the security measures described in our Privacy Policy.
- Tell you about any breach affecting your Customer Data within 72 hours of discovery.
- Help you respond to data-subject rights requests where reasonable.
- Delete or return Customer Data on your request when our agreement ends.
We may use aggregated, anonymized statistics about Service usage (for example, "average requests per inbox") for our own benchmarks, provided no individual or customer is identifiable.
Subscriptions & billing
Plans & pricing
Current plans and prices are listed on our pricing page. Subscriptions are billed monthly or annually in advance.
Payment processing
We use Polar.sh as our merchant of record. Polar handles your payment card data, tax calculation (VAT, sales tax), and invoicing. We don't see your card details. Your payment relationship is with Polar, who acts as the seller of record.
Renewals
Subscriptions renew automatically at the end of each billing period. You can cancel any time from the customer portal — your plan stays active until the end of the period you've already paid for, then drops to the Free tier.
Refunds
Cancellations stop future renewals; we don't issue refunds for partial periods. If a charge was made in error, contact billing@hookspy.io and we'll work with Polar to make it right.
Plan changes
You can upgrade at any time — the new plan applies immediately and we prorate the charge. Downgrades take effect at the next renewal. When you downgrade, your inboxes' settings are clamped to the new plan's limits within 24 hours.
Failed payments
If a payment fails, we'll work with Polar to retry over several days. If it still fails, your subscription is suspended and your plan returns to Free. Captured webhooks beyond the Free tier's retention are deleted.
Price changes
We may change prices for new subscriptions at any time. Existing subscribers will receive at least 30 days' notice before any increase takes effect at their next renewal.
Free tier
We offer a free tier so you can try the Service without committing. The free tier has lower limits (see pricing) and is provided as-is with no service-level commitments. We may modify or discontinue the free tier at any time.
Free tier accounts that show no activity for 90 days may be suspended; we'll email you 14 days before any deletion.
Availability
We aim for 99.9% monthly uptime on paid plans, measured by our status page. We don't currently offer a contractual SLA. If you need one, contact sales@hookspy.io.
We may perform scheduled maintenance with at least 24 hours' notice via email or in-app banner. Emergency maintenance may happen without notice when needed for security.
Suspension & termination
By you
You can cancel your subscription any time from the customer portal. You can request account deletion at privacy@hookspy.io — we'll process it within 30 days and delete your data per our Privacy Policy.
By us
We may suspend or terminate your account if:
- You violate these Terms or the Acceptable Use rules.
- We're required to by law or court order.
- Your activity is causing harm to the Service or other customers.
- Your subscription has been unpaid for more than 30 days.
Where the situation allows, we'll give you reasonable notice and a chance to fix the issue first. For serious violations (illegal activity, attacks, large-scale abuse), we may act without notice.
Warranties & disclaimers
We work hard to provide a reliable service, but to the maximum extent permitted by law, the Service is provided "as-is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We don't warrant that the Service will be uninterrupted, secure, or error-free, or that any data will be preserved or accurate. You're responsible for backing up data that matters to you.
Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or business interruption — even if advised of the possibility.
- Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service is capped at the greater of (a) the fees you paid us in the 12 months before the claim, or (b) [USD 100 — adjust per legal advice].
These limits apply regardless of legal theory and don't affect consumer rights that can't be waived under your local law.
Indemnification
You agree to defend and indemnify us against claims by third parties arising from:
- Your violation of these Terms or applicable law.
- Customer Data you sent through the Service that infringes someone's rights or violates the law.
- Your use of the Service to capture or process personal data without a lawful basis.
Intellectual property
HookSpy, the dashboard, the brand, the documentation, and the underlying code (excluding open-source components governed by their respective licenses) are owned by us. You may use them only as the Service permits.
The HookSpy CLI is licensed separately under the MIT license. See its repository for the license text.
Feedback you send us about the Service may be used by us without obligation to you.
Changes to these Terms
We may update these Terms. For material changes, we'll email account holders at least 30 days before they take effect. Minor edits (typos, clarifications) may be made without notice — the "last updated" date at the top of this page always reflects the current version.
If you don't agree to a change, you can cancel your subscription before it takes effect. Continued use after the effective date counts as acceptance.
Governing law & disputes
These Terms are governed by the laws of [JURISDICTION — e.g., England and Wales], without regard to conflict-of-laws principles. The courts of [CITY, JURISDICTION] have exclusive jurisdiction over disputes arising from these Terms, unless local law gives you a non-waivable right to bring claims in your home jurisdiction.
